Welcome to Atlas. These Terms of Service (the “Terms”) form a binding agreement between you and Wuttipat Klinyam, Entrepreneur Individuel registered in France under the commercial name Wynex Labs(SIREN 100 844 000, SIRET 100 844 000 00016, APE 6201Z, with registered office at 59 Rue Georges Lardennois, 75019 Paris, France) — referred to in these Terms as “Wynex Labs”, “we”, “us”, or “our”. By creating an account or using Atlas, you agree to these Terms.
These Terms incorporate by reference our Privacy Policy and our Subprocessor Register. Atlas serves multiple user types — self-serve teachers, individual learners, and students of institutional customers — and the obligations of each are set out in Section 5.
If you access Atlas through your university or other institution under an LTI launch or institutional licence, the Master Services Agreement and Data Processing Addendum signed between your institution and Wynex Labs (the “Institutional Contract”) take precedence over these Terms to the extent of any conflict, in respect of your use.
Atlas is intended for users aged 15 years or older. By creating a Self-Serve account, you affirm you are at least 15. Atlas enforces server-side age affirmation before account creation completes.
If you are aged 15 to 17, you confirm your parent or legal guardian is aware of your use of Atlas. Where applicable French law (Loi Informatique et Libertés, Art. 7-1) requires parental consent for users under 15 to access information-society services, Atlas does not knowingly accept Self-Serve accounts from users under 15; under-15 access is available only via an LTI launch under an Institutional Contract that confers parental-consent responsibility on the Institutional Customer.
If we discover that an account belongs to a user younger than affirmed, we suspend it and delete the associated data per the Privacy Policy retention schedule. Parents/guardians may contact privacy@wynexlabs.studio for action within one calendar month.
You agree to provide accurate information, keep your credentials confidential, and notify us promptly at security@wynexlabs.studio if you suspect unauthorised access. You are responsible for all activity under your account. We may suspend or terminate accounts that violate these Terms (§17).
Atlas is an educational technology tool. It helps you build interactive knowledge maps, generate and grade practice questions and essays with AI assistance, and analyse learning outcomes against accreditation standards (AACSB, EQUIS, AMBA).
Atlas does not replace a qualified educator's professional judgement. AI-generated questions, AI-suggested grades, knowledge-map structure suggestions, and accreditation-attainment scores are computational aids. They are not authoritative academic decisions. A human educator must review and validate every grade or summative evaluation before it is communicated to a learner or used in an official academic record.
Because every grade passes through human review before passback, no decision producing legal or similarly significant effects within the meaning of GDPR Art. 22(1) is made solely by automated means in Atlas. We rely on this HITL design as the Art. 22(2)(a) and (c) safeguards.
Self-Serve Users are individual account holders. They are responsible for their own Customer Content, the use they make of Atlas with their students, and compliance with the rules of their own institution. Wynex Labs is the data controller for Self-Serve account processing.
Institutional Users access Atlas via LTI 1.3, Azure AD SSO, or other institutional authentication. They are bound by these Terms and by the Institutional Contract (which prevails in case of conflict). For Institutional User data and Customer Content, the Institutional Customer is the data controller, and Wynex Labs acts as data processor under Art. 28 GDPR. Institutional Users seeking to exercise data-subject rights should contact their institution first.
Learners uploading or submitting work are responsible for its originality and for not violating third-party rights or committing academic fraud (§9).
We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence during your subscription (or free-plan account) to access and use the Service for educational or learning purposes.
You retain ownership of all Customer Content. You grant us a worldwide, royalty-free, non-exclusive licence to host, store, process, and create analytical Outputs from Customer Content solely for the purpose of operating the Service for you (or for the Institutional Customer that controls your data).
We do not use Customer Content — including student essays, practice answers, knowledge maps, or any learner work — to train AI models. All AI providers are listed in the Subprocessor Register and are bound by data-processing agreements prohibiting training on inputs; all are configured for zero-retention where available.
When Atlas grades or evaluates learner work using AI, the system produces a suggested grade. The grade is not final or returned to the learner or transmitted to the institution's gradebook until a human educator has reviewed and confirmed (or modified) the suggestion. The grading state machine enforces this. AI-suggested grades that remain in DRAFT/PROFESSOR_REVIEW state for more than the period defined in the Institutional Contract (default 30 days) are auto-expired.
Our processing of personal data is governed by our Privacy Policy. For Self-Serve Users, Wynex Labs is the data controller. For Institutional Users, the Institutional Customer is the controller and Wynex Labs is the processor (Institutional Contract and DPA prevail). For data-subject requests, contact your institution first if you are an Institutional User; privacy@wynexlabs.studio otherwise.
Each party will protect the other's non-public information with at least reasonable care, will use it only for purposes of the Service, and will not disclose it to third parties except to advisors bound by equivalent confidentiality. Information that is publicly known, was rightfully known before disclosure, is independently developed, or is rightfully received from a third party without confidentiality obligation is excluded. Where an Institutional Contract is in place, that contract's confidentiality provisions prevail.
We aim for continuous availability but do not warrant uninterrupted access. Where a change materially reduces functionality of a paid feature you currently use, we give reasonable advance notice and offer prorated refunds for materially-adverse changes. No contractual uptime SLA on the Self-Serve plan; Institutional Customers may negotiate an SLA in the Institutional Contract. Material changes to these Terms are notified by email and in-product banner at least 30 days before they take effect.
If your institution has integrated Atlas via LTI 1.3, Azure AD SSO, or equivalent, your use is governed by both these Terms and the Institutional Contract, which prevails in case of conflict.
Beta/preview features are as-is, may be discontinued without notice, and are excluded from any warranty. Open-source components are governed by their own licences, which prevail over these Terms for those components only.
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranty of any kind, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted/error-free operation. We do not warrant that AI Outputs are correct, that AI-generated questions are pedagogically sound for your course, or that AI-suggested grades reflect any particular standard. The Service is a tool to assist educators and learners; it does not replace professional educational judgement. Nothing in this Section limits any non-excludable consumer warranty under French law.
You will defend and indemnify Wynex Labs against any third-party claim arising from your unlawful use of the Service, breach of §9, IP infringement through your Customer Content, submission of work as original where it is not (§9), or violation of applicable law. We will defend you against any third-party claim that your authorised use of the Service infringes that party's IP in the European Union, provided you notify us promptly and let us control the defence. Maximum indemnification liability is subject to the §18 cap.
Neither party is liable for failure or delay caused by events beyond reasonable control, including natural disasters, war, terrorism, civil unrest, government action, labour disputes, internet/telecom outages, pandemics, denial-of-service attacks, or upstream AI-provider outages. The affected party will use reasonable efforts to resume performance.
These Terms are governed by French law, excluding its conflict-of-laws principles and excluding the United Nations Convention on Contracts for the International Sale of Goods. Disputes are submitted to the exclusive jurisdiction of the competent courts of Paris, France, subject to non-waivable consumer-protection rules that grant a consumer (acting outside their trade or profession) the right to bring proceedings before the courts of their habitual residence.
For French consumers, the mediation provisions of Art. L612-1 et seq. of the Code de la consommation apply. The consumer mediator competent for Wynex Labs is to be designated upon first request to legal@wynexlabs.studio. For Institutional Customers and B2B users, Paris courts apply without exception, subject to any forum-selection clause in an Institutional Contract.
